If it is objected by the card holder only this must be taken as right direction, till then this is very clear to see that incapability of the bank to keep the ATM properly is overlooked and bank wants to escape from the real law. If ATM is defective the onus lies totally on Bank and they should be punished under the law that Bank should return 120% of the amount to the holders account, with 20% extra as the penalty to bank for not keeping ATM in good condition and keeping the account holder in stressed state.
