I have booked a Flat and for which I have paid regular Service Tax to the builder on every Installment paid to him. As GST was applicable from 1st July 2017 I understand that all further payments to the builder will draw 12% of GST. Now the Builder has obtained occupancy certificate on the 11th October 2017 and I have made a payment to the builder on the 20th October 2017, now the builder is claiming for GST on the payment made by me after the Occupancy certificate of the building. He is also claiming for GST on the payment that I have to do on Possession of the Flat. Kindly let me know if GST is applicable to payments made after occupancy of the building/flat to the builder? Dose booking the flat at its under construction stage make it liable for the purchaser to pay GST/Service tax to the builder after he obtains occupancy certificate of the building?
