Billions of Rupees are locked in legal battles since years. If there can be a mechanism through which, the disputes can be settled, it should be welcomed as disputes traditionally consume time, money and energy. However, the mechanism should not be for one entity and the offer should be available for every individual or corporate entity. Further, the mechanism, should be under a separate body who should send its recommendation to the parliament if needed. An off course remedy for one entity is definitely going to raise eye brows specially when the Govt's. integrity is in serious questioning. Mr. Sibal should work towards creation of a body which can take care of such issues. Vodafone is not the only entity facing tax heat. Let there be a court of settlement under the SC which can enter into arbitration's, negotiations, and compromise based on the existing laws or make suitable amendments to reduce the litigation's and work towards recoveries. This however does not mean that a serious offender can be allowed to get away by paying for his crime. Political interference should not be allowed in such matters.
Kejriwal is right,yes there is a conflict of interest, in two counts: 1)If Sibal's son is attorney for Vodafone, then he should not have over ruled the decision of the former Law Minister,who had okayed the tax recovery from Vodafone.The swiftness(within 24 hrs of taking charge of Law Ministry) of Sibal's over ruling is remarkable.Appears the PM intends to undertake a cabinet reshuffle soon,where Sibal may loose Law. 2)Sibal is originally the Telecom Minister and Vodafone is an telecom operator,thus all of their requests/complaints pertaining to this sector is dealt by Ministry of Telecom-Sibal,therefore any tax recovery ordered by Finance Ministry,as Law Minister Sibal should not have favoured Vodafone,which is a telecom operator. Thus on 2 counts there are conflict of interests pertaining to Sibal.This is pointing to another scam.
