i want to know who will pay graduity amount , empolyee or employeer ?

Because our company deducted our salary under this graduity.

I do not know it is rule ?

Please tell it is ok or not.

Hi sir with reference this message i working one co in the month end its come 5 years ,in that regard i taken 2 months leave due to my medical problems after taken treatment i continve service in that regard in case i regin September Month shall i getting gratuity or not

No proper research done. In case you "resign" there is no gratuity! Even the govt employee is not eligible for gratuity on resignation.

When is gratuity payable? (As per Economic Times article)

Gratuity is payable to an employee on the termination of employment after he has rendered continuous service for not less than five years or such other time as prescribed in respect of the specified industries/sectors.

Termination of employment may be on account of superannuation or retirement or resignation or death or disablement due to accident or disease. In the unfortunate event of death or disablement, the aforesaid time limit is waived off.

You are completely wrong. Please go through the contract letter of your company. Gratuity is paid if your association with the company is as per gratuity contract, it depends from company to company, generally minimum is 2 years.
If you resign from your company and your association with the company is as per gratuity minimum stay contract, your company will have to pay you the Gratuity amount.
However, if you resign and leave the company before gratuity minimum stay contract, your Gratuity amount will be gone.

Are school employees eligible for gratuity. i have heard that they are not, my friend completed 8 yrs in a private school and has now changed his job but school says he is not eligible to get the gratuity, can someone help - ajay
