Query on HRA
by Zillaparishad westgodavari on Feb 06, 2011 06:27 PM

Sir,
I am a government servant and employed at state head quarters. I have taken flat in an apartment in my native place after availing housing loan from a nationalised bank. Presently the house is occupied by my parents. I reside in a rented house at my place of work. I have been paying housing loan from my salary. Can I get tax deduction benefit for both the HRA paid at work place and the Principal and Intrest paid towards housing loan? Please clear my doubt.

Can I get HRA tax exemption for the house owned by my wife?
by Guest on Jan 21, 2009 10:26 PM

Sir,
I am a Central Govt.Employee. I am staying in a rented house.
My wife is a home maker and my dependant. She has a house in her name
gifted by her mother. This is informed to my office at the time of registration.
If we shift to this house, can I pay rent to my wife and
claim tax exemption for my HRA?. If so, do I need to inform my office that the owner of the house is my wife?
Pl. advice.

Benefit of HRA as well as Home loan
by Guest on Sep 04, 2008 06:42 PM

I come under the slab of 30%. I am taking the tax benefit of loan repayment. This house is on rent and I mention this rent as an additional income while filling the return. I stay in my father's house and want to claim HRA as well. Please suggest. There is a walkable distance between both the houses. Please suggest, can I also take HRA benefit.

Re:Staying in wife's house? Claim HRA Rebate
by Ramesh Shastry on Aug 03, 2008 11:53 PM

Dear Sir/Madam,

Please note that no person can claim any exemption(s) from HRA received U/s.10(13A) of the Income Tax Act even though if he/she is actually paying rent to his/her spouse for the purpose of accomodation. The relationship between a husband and wife is not commercial in nature; a husband and wife are supposed to stay together. So payment of rent to a spouse will not be accepted by the income tax authorities no matter in whose name the house is registered with.

Dear Sir,

The following are the facts:

1.Out house in the name of my wife

2.She has a Bank Loan in her name

3.I am, from my salary, paying the EMI to
her loan account through my Bank Account

4.She is a Government Employee, has a PAN
and is regularly filing IT returns

5.My salary has HRA

6.I am claiming the EMIs paid by me as rent
paid to her

7.Her IT return contains the income from
house rent which I am showing in my
IT returns

Sir please clarify whether this will be in order

Thanks
