It is a sad day when people do not exercise their discretion in deciding when to take the government to court. If Fali S Nariman is making the argument that the current parliament epitomises the functioning of a healthy democracy boy is he a clueless ingenue! More likely a willing dissembler. When we have someone trying to bring focus and direction to the divestment program, when we know it is of importance to the nation, it is sad to see that process being thwarted. Sadder still because what Fali says is true in a legal sense - the government should seekp parliamentary approval. Whether one can say the same of his motives is a question that can be discussed until the privatisation of underperforming public corporations becomes a reality. Does Mr. Nariman really expect that the parliament will vote out its own ability to disburse favors to their favorites - positions on corporate boards, etc., etc.
the Supreme Court judgement should make Srun Showrie pause and think for a while. Though there could be no objection to disinvestments of PSUs in principle, it not be done in haste and without discrimination. The PSUs gaining profits need not be sold out. Parliament also should consider the point prudently and dispassionately before taking a final decision when government seeks its approval
