It is a pity that SC has taken such a myopic view. This judgement is at the cost of the fundamental right of an intellectually capable but poor/middle class person whose parents do not have an alternative source of income. I can't recollect a single developed country where courts hold credence over professionals/educationists. It should have been left to able professional medical educationists to decide this appeal. Unfortunately, business has prevailed over competence.
SC decision has opened a flood gate for economic exploitation of students seeking admissions to private Medical Colleges run by money sucking 'Pests'. Most of these colleges belong to rich & influential political leaders. All such college lords will be burning lamps of 'ghee' today. It will provide an open gate to extract huge amount of donations to produce sub-standard medical Doctors in future. It's not Medical Council but common students aspiring to become Doctors have lost the legal battle.

This nation cannot create a system for conducting exam, choose it's own candidates, by eligibility test, should not boast of India great, I love India, etc. Seems loopholes are found after intense scrutiny, efforts, interpreting law even from events rarely occurring, so that nothing is allowed to come alive even law.

Problem is we don't punish the culprits, but create another law so that mistakes do not recur. Evil doers get a clean 'go' incentive to be more creative in breaking law.
Every one bows down before power of money. Supreme Court is either too na in this matter or is unable to do anything. One of the worst judgment that will go down in the history of India. Private colleges are given free hand to conduct their own entrance exam. Students has to prepare for several exams and pay several times exam fees. We all know how private college conduct their exams for admission. SC has pushed the several years of advance back in to the pockets private colleges. It should be referred to full bench of SC and once SC decide to set-aside then these 2 judges who passed this judgment must be dismissed. This judgment is very erroneous. SC has no expertise to deliver judgment on academic matters.
A dark day for students preparing for medical exams and their parents. It is victory of Private Colleges who mint money for giving admissions but here in India...who cares?
NEET UG EXAM......DISCRIMINATION OF FUNDAMENTAL RIGHTS.
My daughter was one of the student who was the first batch of CBSE 2011 CCE pattern neet exam.where education minister Mr. Kapil Sibel himself had congratulated her for that.Today even after getting 10,000 rank in All India state quota and 6000 rank in category quota in NEET-UG 2013 for MBBS out of 6.5 lakhs students appeared. she is not getting admission in the states of Maharashtra and Gujarat and Delhi due to discrimination in education policy. like neither she is a domicile of Maharashtra nor she passed class 12th exam from any state board or nor she is from a particular state e.g Delhi or Gujarat. The private colleges are asking between 40-70 lakhs for admission in MBBS. Are Indians so rich?? where are we living ? what is our education policy ? Therefore friends please suggest us what should we do as she wants to become a doctor and serve the country. Her dream to become a doctor will die like this??.There are hundreds of such students like her.will education minister of India wake up for these hundreds of helpless students?? Will education minister take a bold decision like peroleum ministry that petrol/diesel price hiked from midnight and every state has to follow it !

This is true Mr Sachin upadhaya. First we are effected due to reservation and second our education policy is very bad. If we have money we become a doctor other wise no meaning of our merit or marks. Our marks and merit is like peanut according our vacancy in our colleges.

Why only Maharashtra, Delhi or Gujarat? Other institutions are also very good, some are better too.

You are right, others states are similar.why not have separate merit list state wise. There will be no grudge of parents and political parties for vote bank.
This is only to help the PRIVATE MEDICAL COLLEGES to mint money as they are selling there SEATS for HEAVY AMOUNT and DONATIONS which were earlier banned by hon'ble supreme court
