loan recovery agent
by Rakesh Kumar on Mar 17, 2016 01:16 PM

I am constantly getting calls from mobile no. 7065177285 named Rajiv Tyagi stating himself as an employee of ICICI Bank and threaten me to pay the dues of outstanding loan. The person has called numerous calls to my family members as well as to my known peoples, perhaps getting nos. from my call data record obtained illegally from the service provider. He used abusive and harsh/filthy language and defaming me in the society. I think this is clear violation of RBI Guidelines. I can provide the numbers on which this person has called in the past days and used abusive language. I am planning to report the matter to RBI, Human Rights Commission and also lodge a complaint with Delhi Police for Life threat, harassment and mental torture.

I Strongly belive that that Fair Debt Collection Practices Act should be enforced in India. I too work for a US debt collection agency and trust me its very stringent and debtor centric. Atleast i would feel secure if i were in US and behind my debts, but in india i dare not default on any of my bills or else i am screwed. Can someone do about this. Well to share an incident . My friend owed a Credit card debt, but what the heck i was called by the agent, asking for his personal wareabouts, i was stunned when ge told me that ge owes money, and that is why he was calling me, when i refused to give any information we got agressive and started to give out my information, sed i'll see you there , i'll come to your place, you need to make him pay. I lost my temper and asked him not to call me again, but he started to threten me sayin he will block my credit card as well coz u are refusing to give me his land line #. I also told him he cannot do that but he kept on saying, he can ...he sed you dont know me ... i can do nethin. I'll pick you up from ur place. That was funny though made me realise that this would not hav happned if we had somethin like FDCPA in US. I hate to say but India needs to progress a lot, especially protecting consumers, but yet i agree its a debt which you owe and u need to pay that, but at the same time keeping in mind that this is just to stop or rather protect consumers from the extreme harassment.

We are a professional debt collection company. We happen to come across statements made by victims of arrogant behavior of the debt recovery agents. Fortunately no complaint has been made against us but being in the similar line we felt we should clarify.

I would specifically like to mention that we are in the line for more than six years now working for all major nationalized banks and corporate houses. We have instructed our staff that they should not use bad words or filthy language. And in fact the total conversation done on phone is recorded and subsequently perused by seniors to help and advise telecallers on improvement. We at our end are continuously finding ways to get results without arguments. We are of the firm opinion that muscle power is not an advantage but a disadvantage in recovery. Explanations, clarifications, convincing ability and consistent follow up are what are required to succeed in recovery. It requires maturity in handling.

We have received complaints many times that the telecaller from our office had threatened to kill, or that some bad words were hurled. Every time even the police get carried away by the statement of defaulting borrowers. But let me frank with all honesty at your disposal that on going through the recorded conversation, we have never found the telecaller at fault. It was noted that the borrower had been attempting to evade calls or payments; however telecallers have been repeatedly trying to get through to contact the bor

dear indians, umpteen number of friends have expressed candid and useful views but who is listening? who is taking action? who is getting justice?that is where we are lacking. let someone do something for action taken.otherwise
it is only venting frustation which we are already doing verbally every day.

Name the Private sector bank
by Ramachandran venkatesh on Jul 08, 2007 04:52 PM

Why does REdiffmail refer to the bank as ONE PRIVATE SECTOR bank. Mention the name of the bank. Take legal action to ensure that
The bank and all its commercial transactions are frozen and suspended.
The top brass and whoever was responsible for the incident are charged with murder.

In a civilized society, the only agency authorised to use force is the police. It can do so only on orders of a court. In this case also there are safeguards. A verdict of a lower court can always be challenged in a higher court. If a stay is obtained/ the judgement of lower court is reversed the police cannot take any action.

If the so called elite private sector banks employ hooligans in what way are the different from any of the D-COMPANIES (Dawood Ibrahim compaies)

Citibank on the prowl
by Saurav Mukherjee on Jul 07, 2007 04:26 AM

This is one more unethical bank in the bunch of overseas bank who promise good service. I applied for a card from this bank last month I had given them my Pan card and salary slip. However the next day one of the employees visit me to get another form signed. But he has my other documents that i had given to the ICICI bank employee for a card. On questioning I was informed that the ICICI Bank executive has sold my documents to this Citibank employee. When I wanted to speak to the manager at Citibank I was threatened that i cannot question his employees. I decided to cal lthe police as I was not sure if my documents were miss used. But decided not to as we all know the kind of harresment I will have to go through. Later I found out that my original application was also declined by Citibank. Apparently these banks would not like to any of their customer to be aware of consumer rights. If you are aware of your rights they would rather decline your application than have you as their customer.

So friends, Banks your should not have any transactions with are CITI BANK, STANDARD CHARTERED BANK, ICICI BANK and SBI. If you are a customer with any of these banks...please make sure you Pray everyday to keep your identity and money safe with them

Harasment by recovery agents
by on Jul 07, 2007 03:12 AM  | Hide replies

Hello,

So my case goes like this-------

I was working with IBM in Delhi in 2004 and a credit card agent had put a counter exclusively for processing credit card for the employees of IBM, so I applied, I gave them the documents of my permanent address as I was putting up at my temporary address at the company owned flat.

I kept on asking the status of my credit card as to whether it has been accepted or rejected, the company customer service agent keeps on telling that right now he have no information about it.
Then I moved on and made a credit card of different company which I got and then slowly I forgot about my application at the bank. In the meanwhile I also changed my address.
Now the company tells that they have delivered my card at my earlier address that time .They did so without my signatures, or proof of id,etc.
Someone else got the card and made the purchases for the amount of the card.

Now from the 2 years company is after me as they had my permanent address, and their recovery agent is using all such cheap means to abuse me and my family members.

I want to ask you what can be done now. Whether I can report this to Police or can take a legal action.

The company can also take a legal action, so what can be done regarding that?

I have 3 other credit cards till date for which I am paying all my dues regularly
I told them to explain how can they deliver the card to anyone without my signature and proper proof of id they had no answers
Please

It would be in your interest if you register a case with Police and also approach consumer court over the matter

I am surprised that you still wait for guidance, the first and foremost is you approach customer redressal forum and sue them for undue harrassment. It is very certain that they wiil bow down and stop calling.
