4TH CATEGORY-MARRIED DAUGHTER OF SISTER OF US CITIZEN
by Vishal on Jan 30, 2009 04:04 PM

Dear Sir/Madam,A INDIAN Girl married a Indian on May 2005, before she received her Green Card in Aug 2005 in New-Mexico, USA.There was a rule that only UNMARRIED Daughter will receive the Green Card ie.F4-CATEGORY. She went to USA on F4 Category ie.UNMARRIED Daughter of Brothers & Sisters of US-CITIZEN. Her Mother has filed for F4 CATEGORY since 1992.Her Mother received Green Card through her Sister who is a US-CITIZEN. And hence her daughter too received the Green Card due to UNMARRIED DAUGHTERS ie.21 years. Her Present status is UNMARRIED but she is married since MAY2005.What are the CONSEQUENCES of the above situation? Is the Girl ILLEGAL according to US-IMMIGRATION LAW since she has married before getting the Green Card?
KINDLY GUIDE ME

NO NO AND NO
by Saurabh Sharma on Apr 29, 2006 06:40 AM

Dear Editor,
I read your article and am quite surprised to see a lawyer quoting such irresponsible statement. Please note his comments on first question.

One can get H1 visa while one is in US but in order to get stamping on passport - the person will have to take the H1 approval(I 797) to US consulate outside US.

Prior to 9/11 US used to do stamping at St Louis, US but they closed that out and now one has to travel outside US and appear for a face to face interview. So if someone like me came to US on F1 visa(has F1 on Passport) and then gets H1 visa while staying in US- He will have to go outside US to get the stamping on passport.

It is advised (www.nvars.com) to get stamping in home country but one can visit other countries as well.

So his statement is entirely incorrect. Please feel free to contact US consulate helpline at (888) 840-0032 from Canada and the U.S to verify the same.
Thanks,
