Reg the service tax

Hi,



I have bought a flat and the builder is asking for service tax @12.24%. Is there any GO from the govt that the consumer has to pay. If yes, can anyone tell me the GO number and where can I find that?



He is telling, if I don\'t pay he will stop giving the possession. I have paid the full amount and the registration happened in January 2006.



Can anyone clarify me in this regard?

STT can not be more than 10.3% of 1/4th of BSP PLC. Moreover it is applicable only for under construction property.

Do we really need to pay service tax?

I bought a flat in August 2005.
Now at the time possession the builder is asking for Service Tax from me. He never intimated about it earlier. Also the formula that I was told to calculate this tax is this - 10.2 % of 33 % of (The agreement cost - proprotinal land cost). Even if the case regarding this service tax law is pending in court as the builders in Pune have challenged the law, the builder is asking for this tax.
Has anybody faced this kind of situation? What should we do in order to verify the legality of the thing?

Dear Sir,
I have puchased the flat on 24.march.2005, and the same's posession will be getting the May 2006. And now the builder is asking service tax.
Am I elibile to pay service tax. I have completed the 100% payment to the builder.

pleae clarify.

Hi,
I have booked a flat on in the month of May 2005 and the registration the said flat is happend on 24th May 2005. I have paid the 95% of the money and for the rest amount I had given a post dated cheque. The builder has promised me the posession of the flat in Dec 2005, but it is not happend. And today I got a call from the builder saying that, your flat is ready and you can take the posession by May 1st week, and now you have to pay 10.2% of service tax for the flat cost.
This is nowhere mentioned in the agreement and what is this cost for?
Could you please help to get the clarification

Builder sold a flat to my client. It is already registered in the month of November,2005. Now the buider is demanding service tax from my client. How far the builder can demand? Is my client liable to pay the service tax.

Input credit of Service Tax

Sir,

I am A builder and Iam a service Tax payar.
I choose to pay 10.2% of 33% of the total cost of the flat/villa. I would like to know that can get input credit which I paid (Service tax) to My Consultants, Architects, Advertisements,telephone bills etc. Please clarify
