the state govt. and the protem speaker intentionally disobeyed the verdict of supreme court as also over looked the advice of hon.president of india. neither the govt. or the speaker has right to remain in power.this is clear-cut insult of the constitution and the first person of the nation.there is no need to have opinion/advice/counselling from the constitutional pundits. this is the real colour of self-centered selfish politicians - they think that their political party is higher/supereme to the nation.this is nothing but a process of nailing the coffin of liberrty/independence and constitution.even 1000 dandi yatras can not reverse the gears of power hungry politicians. MAY GOD SAVE THE MOTHERLAND.

vote should have been taken up by the Jharkhand Speaker
by a k mukherjee on Mar 11, 2005 10:07 PM

It is unfortunate that breaking all democratic principles and directive of the President and the Supreme Court the Speaker of the Jharkhand Assembly and the Sibu Soren party did not allow the voting on the question of proving majority in the Assembly. It is sad that the Congress Party President or the Prime Minister did not advise their party to behave democratically.Democracy is being killed for petty Party power.Hope Supreme Court takes a stern view and punish the people responsible for this act.

In support of Nariman\'s comments on the issue of Jharkhand
by Anil Kumar on Mar 11, 2005 09:16 PM

Yes, I totally agree with Nariman in this issue. The confidence Vote should have been taken up. This incident may give the wrong impression to the public on the power of supreme court of India. If the respactable MLAs themselves go against the law(the ruling given by highest court in the country) in public that to in a place where the law has to be created, what about the other people and in that case we cannot say what the rowdis and gundas are doing as against law.

I strongly oppose this whole drama played by all the MLAs in the state of Jharkand.

Make law to avoid such situation
by Adnan Saifi on Mar 11, 2005 09:03 PM

Before giving my comments i would like to raise some issue:-
"Why political parties are making so much hue and cry on this issue for which they are solely responsible."
"Why they are evading a debate on this and making a law to aviod such situation."

1> Which party should call first to form a popular government in the state and their time period?
2> who will conduct the assembly for the vote of confidence either elected speaker or nominated.
3> What will be the role of Governor in such situation as happened in Jharkhand?
4> Is there any justification in taking oath as a Chief Minister without proving the majority?

"Just make some amendment in law to limit the role of Governor"
"Deadline sould be same for all states in India to prove majority in the floor of the house."
"First prove the majority in the floor of the house and then take oath as a Chief Minister."
" Party having pre-poll alliance should call first, then single largest party and then post poll alliance if they claim to form a government in case of hung assembly."
"Speaker of the last assembly will conduct the trust vote in a transparent manner".
