Bihar: PIL against Prez rule

It is hightime the role of the CEC is further extended.

It can be extended till a government gets installed in a state or the center.

Firm and definite guidelines need to be worked out as to who should be invited to form a government, the verification, vigilance over horse trading, and all the other factors surrounding the making of a government where no single party has emerged as a clear victor capable of making its own exclusive government.

It will be the Chief Election Commissioner who would recommend the introduction of Rashtrapati Shaashan once all the other attempts, they need to be clearly definied like a work flow chart, to form a government,
have exhausted.

Today, any Tom, Dick and a Governor calls any guy or doll to form a government, at the behest of the power in centre, or recommends Rashtrapati Shaashan, again at the behest of the center, even defying the possibilities of the formation of an unwanted (by centre) government, the centre remote-controlling the Governor in contravention of the provisions of the constitution, which again in any case is too weak and too ambiguous under such circumstances.

This is an issue demanding serious, urgent and earnest deliberation by the constitutional pundits to protect voters.

However, excepting that High Court judge of Allahabad (Justice Sinha ?), the ruling party in the centre cares a damn for the judiciary, be that the saffron, the safed topi, or lately the rainbows.

In any case, this is a welcome move rather than dharnas, demonstrations and stalling the proceedings of the House.

Let the judiciary opine on this dangerous trend of superimposing the adult franchise with a presidential rule to pave way for the centre to govern by proxy.
