It is elementary. Any body with some knowledge of legal processes would have known it. Surely Kumble knew about it when he decided to withdraw the charges against Hogg. Now Harbhajan who did not abuse stands penalised and Hogg who actually abused does not even face charges. This is the sense of justice of Kumble, the great, who places his own image above the team/player's prestige. Does he intend to to file nomination in the next Lok Sabha elections?
THIS IS A SADDEST COMMENT BY ICC. ICC IS ALSO ACTING LIKE BCCI. INDIAN PEOPLE WILL DEAL WITH ICC AS AND WHEN ICC VISITS INDIA. BCCI KINDLY DO NOT SURRENDER TO ICC. REQUEST INDIA TEAM TO COME HOME. INDIAN PEOPLE OVER ONE BN WILL GIVE THEM A ROUSING RECEPTION NOT SEEN YET IN WORLD. HARBHAJAN SINGH IS PRECIOUS TO US, HE IS LIFE TO US AND HE IS NOBLE SON OF INDIA.

Anil Kumble is insesitive to the sentiments of Harbhajan. He is also insensitive to the feelings of millions of INdians who have passionately supported the team India. Now only we learn that this team is subject to the whims of Mahatma Kumble and his master BCCI. It is either team Kumble or team BCCI but certainly not team India. All players who play for national pride shd desert this team as soon as they come back in the same spirit in which many Indians used to boycott Govt. Service and Govt. colleges in pre-independence days. I am sure they will find monetary compensation with the ICL.
It was kinda funny reading the reason why the charges cannot be dropped.. BECAUSE they were framed not by Australians, but by the UMPIRES..
And poor gullible me, who was seeing the match live, seem to have a faint recollection of the honourable Mr. Procter coming live on the camera at end of play and CLEARLY stating that the Umpires DID NOT hear anything..
It beats me how someone who did not hear or see anything can frame charges. I heard of witnesses who are skillfully cross-examined by opposing counsel to prove they are not worthy witnesses.
But this hilarious classic comedy is the one where unwitting, "I-did-not-hear-that" variety people are wantonly (but that may be wrong, the Aussies might have pressurised them into making those charges) framing charges after having publicly stated that they know nothing whatever about the subject.
As pointed out by other avid readers elsewhere, it seems to be in ICC's heritage to hide behind any rule, technicality or illegality to somehow ensure that the players from the sub-continent continue to be charged and banned, while their white counterparts' cases are constantly buried behind technicalities and illegalities of some other kind.

we as Indians are to much concerned with the cricket and forget all other sports.That is why it is called players are Bunch of Rascals.
There is nothing in that game which is intersting to be intersted.
many captain were banned or penalised for slow over rate which is a minimum level of the violation as per code of conduct of the game .but ponting behaviour & fail to control the match & brought the game to dispute. ah ah this is true white skin run business ICC.
