It was a Constitution Bench of the same High Court that declared in 1976 that the Indian Council of Agricultural Research was not a State. On an appeal, this decision was overturned seven years later by a Division Bench of the Supreme Court. But (I think) the Council of Scientific & Industrial Research, the Indian Council of Medical Research, and similar bodies are held to be non-State even today.
If BCCI is held to be a State (for purposes of Article 226 of the Constitution of India), it will probably be good for our cricketers, because they will be enabled to question the decisions of BCCI, if need arises, through Writ Petitions. However, it could be viewed as a reversal of the "privatization" policy of the Government.
